A German court has ruled that a French e-liquid manufacturer infringed a famous trademark in a judgement that prevents the sale of the offending brand design anywhere in the EU.
The regional court in Bavaria ruled that the logo for Choops Liquids was too similar to the Chupa Chups lollipop logo designed by surrealist artist Salvador Dali.
The case was brought by Perfetti Van Melle, the makers of Chupa Chups, against e-liquid company VFP France, based near Charles de Gaulle airport in the Mitry-Mory suburb of Paris.
Perfetti Van Melle, with headquarters in Italy and the Netherlands, is the third largest confectionery concern in the world. It began legal proceedings after unsuccessfully requesting the Choops manufacturer to change its logo in 2017.
The decision applies at a European level on the basis of a 2009 European Council regulation, cited by the judge in the case.
