The French regulatory framework for e-cigarettes changed in 2025, as the National Assembly and Senate approved a bill banning disposable devices entered into force in February 2025.
Ordinance 2016-623, which transposed the EU Tobacco Products Directive (TPD) into French law, and law 2016-41 of 26th January 2016 on modernisation of the health system, amending several key aspects of the Public Health Code, are the chief regulatory instruments governing e-cigarettes in France. Both were adopted in 2016. Nicotine-containing e-cigarettes and non-nicotine e-cigarettes are regulated equally in some aspects, such as advertising, age restrictions and public place use.
