13th November 2023: US - Louisiana: The Louisiana Office of Alcohol and Tobacco Control has released a list of approved e-сigarettes and alternative nicotine products, known as the V.A.P.E. Directory. The list contains 397 products that are authorised to be sold in Louisiana, including Juul products and Zyn nicotine pouches. From 1st November 2023, only products that are included in the list can be sold in the state. To receive authorisation, products need a marketing order from the US Food and Drug Administration (FDA) or must meet one of several exceptions, which favour products that have been on the market since at least 2016, as stipulated in House Bill 653 that passed earlier this year.
3rd July 2023: US - Louisiana: The excise tax on vapour products increased on 1st July from $0.05 per ml to $0.15 per ml, as stipulated in Act No 414. From 1st October 2023, every vapour product and alternative nicotine product manufacturer must register each product with the Louisiana Office of Alcohol and Tobacco Control (ATC). The Vapor Product and Alternative Nicotine Product Directory will be available on the ATC’s website by 1st November 2023.
18th May 2023: US - Louisiana: House Bill 179 has been passed by the House and now heads to the Senate. The bill would ban the sale or service of any e-liquid or vapour product with any flavour other than tobacco.
20th April 2023: US - Louisiana: House Bill 635 has been introduced, which would increase the tax rate on vaping products to 15% of the retail sales price.
29th March 2023: US - Louisiana: House Bill 179 has been introduced, which would prohibit the sale or service of any e-liquid or vapour product with “a characterizing flavor” – the definition of which would ban all flavours but for tobacco.
23rd November 2022: US - Louisiana: The Department of Revenue has published a rule amending the Louisiana Administrative Code (LAC 61.III.1533 and 1534) to mandate electronic filing of tobacco tax returns and reports by retailers of vapour products and electronic payment of the tax. The proposed rule was published on 20th August and heard on 27th September.
