5th September 2024: Luxembourg: The Ministry of Health has provided ECigIntelligence with the list of notified vaping products in the country. The list includes nicotine-containing and nicotine-free vaping products, both of which need to be notified.
2nd August 2024: Luxembourg: The Environmental Administration has inspected 45 samples of single-use e-cigarettes from 11 different points-of-sale and found that the labelling was insufficient in 27 samples out of the 45. In addition, 39 of these 45 were not notified and so removed from the Luxembourgish market.
21st May 2024: Luxembourg: The government has proposed amendments to the bill that would have made nicotine-free e-liquids subject to some of the product restrictions currently applicable to nicotine-containing liquids. It has proposed deleting this provision, as “it goes beyond what is provided for in the Tobacco Products Directive 2014/40/EU”.
10th May 2024: Luxembourg: The Council of Ministers agreed yesterday (9th May) to approve a bill that would make nicotine-free e-liquids subject to some of the product restrictions currently applicable to nicotine-containing liquids. These include the prohibition to contain vitamins or any other additives that give the impression the product has any health benefits, caffeine, taurine or other stimulants associated with energy and vitality, colouring additives and additives which, without combustion, have carcinogenic or mutagenic properties or are toxic to human reproduction.
29th April 2024: Luxembourg: The regulation introducing a tax for e-liquids (which are currently not taxed), regardless of their nicotine content, was published in the Official Gazette on 26th April 2024. The regulation introduces a tax of €0.12 per ml, which will enter into force on 1st October 2024.
7th March 2024: Luxembourg: The Ministry of Finance has proposed a draft regulation seeking to introduce a tax for e-liquids, regardless of their nicotine content. Currently not subject to any specific tax, e-liquids would be taxed at €0.12 per ml. The proposal follows the plans announced yesterday, 6th March, by the Ministry of Finance during the presentation of the 2024 budget to tax e-liquids in the country. The tax would enter into force on 1st October 2024.
11th January 2024: Luxembourg: Last month (December 2023), the government notified a bill amending the tobacco law to the European Commission’s TRIS system. This replicates the same provisions envisaged in a similar bill notified a few days earlier, namely subjecting nicotine-free e-liquids to the product restrictions currently applicable to nicotine-containing ones. The new bill just includes a nicotine pouch ban. The end of the standstill period is 22nd March 2024.
13th December 2023: Luxembourg: The government has notified a bill amending the tobacco law to the European Commission's TRIS system. It would prohibit nicotine-free e-liquids from including – as ingredients – vitamins or any other additives that give the impression the product has any health benefits or that it has a reduced risk to the consumer’s health, caffeine, taurine or other stimulants associated with energy and vitality, colouring additives, additives that facilitate the inhalation or absorption of nicotine, and additives which, without combustion, have carcinogenic or mutagenic properties or are toxic to human reproduction. The end of the standstill period is 6th March 2023.
26th May 2023: Luxembourg: The Ministry of Health has published an official webpage on the harmful effects of tobacco, ahead of World No Tobacco Day, which will take place on 31st May. The ministry raises concerns over the fact that "new types of products have emerged and are particularly targeted at young people", especially because "these products use very fruity flavors and are designed to be as appealing as possible to young people". The webpage also refers to a study that provides figures on the country's vaping population, which has increased from 9% of the population in 2021 to 13% in 2022.
5th July 2022: Luxembourg: In answer to a parliamentary question about whether the increased use by teenagers of flavoured disposable e-cigarettes, as seen in France, was also occurring in Luxembourg, health minister Paulette Lenert said yesterday that as none of the notification fees for disposables had been paid, their presence on the market was illegal. She added that while it did not currently have usage data on these products, “the Ministry of Health takes the emergence of this type of product very seriously [as] the electronic cigarette in all its forms or variants constitutes a potential health risk”.
