22nd July 2024: US - New York: Democrat councilwoman Kamillah Hanks has introduced a bill in the New York City Council that would prohibit the sale of e-cigarettes that resemble school supplies, including any that could be mistaken for highlighters, staplers, writing pens, or pencils.
3rd July 2024: US - New York: The city of New York has filed a motion of preliminary injunction to immediately block 11 companies from selling their e-cigarettes in the state. The city filed a lawsuit against these companies in April, citing data that kids are becoming addicted to flavoured e-cigarettes at alarming rates. The lawsuit claims that the 11 wholesalers – located in Brooklyn, Queens, Long Island and upstate New York – are accused of selling the vapes in violation of local, state and federal law. “While we have already filed a lawsuit to hold these distributors accountable for their actions, the motion we have filed will help us ensure that they can no longer peddle this poison to our children while this case is being litigated,” mayor Eric Adams said in a statement after the request for an injunction.
21st June 2024: US - New York: State attorney general (AG) Letitia James has announced that funds coming from the settlement with Juul will be allocated to Central New York (more than $4.7m) and the Finger Lakes region (more than $7.4m) to fight what she called the “youth vaping epidemic”. James said: “Juul preyed on young people across our state by putting addictive products into their hands and convincing them that they were harmless. Their actions put a generation of children at risk, fueling physical and mental health problems among young New Yorkers.”
24th May 2024: US - New York: Assembly Bill A10377 has been introduced. The bill would prohibit labelling or marketing vapour products with certain terms, designs or imagery; for example: bubble gum, cake or popsicle. The bill would also prohibit the marketing of materials, images or references to cartoons, cartoon characters, superheroes, television shows, video games or movies used to market to minors. It would further prohibit the marketing of e-cig products with imagery or food brands that have been commonly marketed to minors.
10th April 2024: US - New York: Bill S 9012 has been introduced, which would create a vapour product directory in the state. The attorney general must develop a vapour product directory listing all manufacturers and all vapour products that are sold in the state, and publish and maintain the directory on its website.
8th April 2024: US - New York: New York City mayor Eric Adams and New York City corporation counsel Sylvia O. Hinds-Radix reported that the city of New York has filed a lawsuit against 11 wholesalers for the illegal sale of flavoured disposable e-cigarettes. According to a statement from the city, the 11 defendants are alleged to have distributed (and continue to distribute) youth-friendly-flavoured disposable e-cigarettes (such as Strawberry Colada, Mellow Mint, Blueberry Energize and Frozen Creamsicle) to retail vape and smoke shops, convenience stores and directly to consumers over the internet, in violation of federal, New York state and New York City law. The lawsuit seeks to block the defendants from further sales of these illegal items and seeks damages and penalties. “This lawsuit continues the city’s enforcement effort against companies that flout the law by selling flavoured vapes to retailers and directly to consumers in the city,” said Hinds-Radix.
19th February 2024: US - New York: Bill A 9224 has been introduced, which would prohibit the sale of tobacco products and vapour products within 500 ft of a public or private school.
28th November 2023: US - New York: Bill S 7771 has been introduced that seeks to prohibit the sale of disposable e-cigarettes in the state. Any person or firm that violates this provision would be subject to a civil penalty of up to $100 for each individual disposable e-cigarette package sold or offered for sale.
7th November 2023: US - New York: Bill A 8243 has been introduced. The bill would require random, quarterly inspections of retail premises authorised to sell tobacco and vapour products to ensure compliance with applicable laws and regulations.
27th October 2023: US - New York: Bill A 5994 has been signed by the governor. This bill prohibits misrepresenting any facts about the health consequences of using e-cigarettes, and provides related penalties. It also prohibits the promotion of e-cigarettes. The act will take effect on 1st of January 2024.
18th September 2023: US - New York: Governor Kathy Hochul has signed public health legislation (A1025/S50) that amends the public buildings law to prohibit the sale of tobacco products in vending machines and at vending stands leasing space in buildings in the state. Future vendor leases and contracts will be subject to this prohibition. The governor said: “We’re cracking down on Big Tobacco by banning the sale of their harmful products in New York State buildings. Protecting public health is a top priority for me, and I will continue to discourage the sale and use of these dangerous, addictive products in New York.”
2nd August 2023: US: The US Public Interest Research Group (PIRG) is urging convenience stores and gas stations to stop selling disposable vapes. The plea quotes from a recent PIRG report: “E-waste, already the fastest-growing waste stream in the United States, is further exacerbated by the inclusion of disposable vapes...The nicotine e-liquid in these products prevents their legal recycling and contributes to their accumulation in landfills and across marine ecosystems.” It also says “e-cigarette companies created a dangerous health threat to young individuals,” citing a lawsuit recently filed by New York City mayor Eric Adams against four companies for illegally selling disposable flavoured e-cigarettes.
