6th March 2025: US - New York: Assembly Bill A6444 has been introduced. The bill would prohibit the sale of disposable e-cigarettes in New York State. If passed, it is set to take effect on 1st January 2026 and aims to reduce tobacco-related health issues and environmental waste.
21st February 2025: US - New York: New York attorney general Letitia James has filed a lawsuit against 13 major vape manufacturers, distributors and retailers for illegally marketing and selling flavoured disposable e-cigarettes, such as Puff Bar and Elf Bar, to under-21s. An investigation by the Office of the Attorney General found these companies use deceptive tactics, including misleading safety claims, illegal shipments to New York and violations of health regulations. The lawsuit seeks hundreds of millions of dollars in penalties for violations of local, state and federal laws, along with damages and restitution for the public health impact. It also demands the recovery of profits from illegal sales and the creation of a fund to combat youth vaping in New York.
5th February 2025: US - New York: Assembly Bill A4593 has been introduced. It would create a vapour product directory that manufacturers must register with, requiring them to attest that their products were either on the market as of August 2018 and have a pending Food and Drug Administration (FDA) application or have received FDA marketing authorisation.
5th February 2025: US - New York: Assembly Bill A4619 has been introduced. It would define new terms like “flavored nicotine analogue product” and "nicotine analogue”. The bill would also prohibit the sale of flavoured nicotine analogue products in the state.
5th February 2025: US - New York: Assembly Bill A4540 has been introduced. It would require the New York State Department of Health to create a public web page listing compliant e-liquid manufacturers and develop a scannable code that can be used to verify a manufacturer's status on a smart device. It would also increase the tax on vapour product sales from 20% to 41%.
30th January 2025: US - New York: The New York State Department of Health has announced the arrest of a vape shop owner and e-liquid manufacturer from Central New York for allegedly selling vape juice (also known as e-juice and e-liquid) illegally through the post. This marks the first arrest in the state under a Public Health Law statute enacted in 2020, which criminalises the shipment or facilitation of shipping vapour products. State health commissioner James McDonald said that the arrest underscores New York’s commitment to reducing youth vaping and enforcing laws to protect public health.
27th January 2025: US - New York: Senate Bill S3196 has been introduced. S3196 would prohibit the retail sale of flavoured tobacco products in the state. The bill defines a “characterizing flavor” as any distinguishable taste or aroma other than tobacco, including flavours related to fruit, chocolate, candy, desserts, alcoholic beverages, mint, herbs, spices or menthol.
24th January 2025: US - New York: Assembly Bill A3222 has been introduced. A3222 would prohibit the sale of disposable e-cigarettes in the state. Specifically, the bill defines a disposable e-cigarette as any electronic cigarette that cannot be refilled with vapour products.
15th January 2025: US - New York: Assembly Bill A1709 has been introduced. A1709 would prohibit the sale of any vapour or tobacco products that contain the substance N-Ethyl-p-menthane-3-carboxamide, which creates a cooling sensation similar to menthol.
15th January 2025: US - New York: Assembly Bill A1687 has been introduced. A1687 would prohibit the packaging, sale and distribution of confectionery and candy designed to resemble a tobacco product.
13th January 2025: US - New York: Assembly Bill A1636 has been introduced, which would ban the sale of any “quantity of electronic liquid used to refill an electronic cigarette or cartridge”.
8th January 2025: US - New York: Bill A00273 has been introduced. It would prohibit the sale or distribution of e-cigarettes that lack Food and Drug Administration pre-market approval, and impose penalties of at least $10,000 for violations.
