In this report we detail UK regulations with regard to tank size limit for new products, public usage and the advertising, sponsorship and promotion regime for e-cigs. This report provides updated information to include guidance issued by the MHRA on complying with regulations on dealing with possible adverse health effects of a product and on due diligence for e-cig and e-liquid suppliers.

E-cigarettes and e-cig products containing nicotine are currently regulated in the UK under the Tobacco and Related Products Regulations 2016 (TRPR), which implemented the EU’s Tobacco Products Directive (TPD) but with a minimal approach. With the UK’s planned departure from the EU, the TPD would no longer apply but the Tobacco and Related Products Regulations 2016 would remain in force with minor amendments. Variations in interpretation of the TPD are discussed in this report and we give an overview of the possible post-Brexit changes to the UK regulation of e-cigarettes.
