The Federal Tobacco Products Act and the Tobacco Products Ordinance entered into force on 1st October 2024, regulating both nicotine-free and nicotine-containing e-cigarettes in Switzerland.
An e-cigarette is defined as a “device that is used without tobacco and with which the emissions of a liquid heated by means of added energy can be inhaled with or without nicotine, as well as refill material for this device”.
In addition, nicotine-containing refill cartridges must be marketed in accordance with the Chemical Law.
The Federal Tobacco Products Act guarantees uniform regulation across Switzerland, but cantons (which are in total 26) are entitled to implement stricter regulations.
This report provides a detailed analysis of the regulatory regime in place for e-cigarettes in Switzerland, covering all policy areas from taxation and advertising to market access and sanctions.
