The office of state attorney general Pam Bondi is lobbying the Florida Supreme Court to allow a vote on whether to include the ban in a wide-ranging referendum next month.
The vote was struck down last month by circuit judge Karen Gievers, who ruled that “bundling” the question of indoor vaping with the issue of whether to allow offshore drilling violated voters’ rights.
While the rights of vapers – and potentially those who might object to vaping – may be at stake, the argument is entirely about procedure, not the rights and wrongs of any ban.
