France: The Court of Cassation (France’s highest appeal court)
upheld a ruling in the case against the French subsidiary of British American Tobacco (BAT) brought by the anti-smoking associations Tomorrow Will Be Smoke-free (DNF) and the National Committee Against Smoking (CNCT). BAT was accused of illegal advertising of its vaping products via its website, social media and newsletters. The decision imposed a €100,000 fine on BAT France for illegal advertising and promotion of vaping products. The court
confirmed that newsletters and electronic communications promoting vaping products constitute prohibited advertising, and that communication strategies aimed at associating vaping products with positive values or healthy living are illegal.
