US - Utah: Senate Bill (SB) 61 has been signed by the governor. The bill prohibits the sale of e-cigarette products that have not received or are pending market authorisation from the federal Food and Drug Administration (FDA). SB 61 will further prohibit the sale and distribution of flavoured e-cigarettes (not including menthol or tobacco flavours). Both prohibitions are set to begin 1st January 2025. Additionally, it will also create an e-cigarette product registry, and products not included in this registry will not be able to be sold from 1st January 2025. Finally, the bill will impose nicotine restrictions, including in the definition of “premarket authorised or pending electronic cigarette product” (the only type of product that will be allowed on the market) products that do not exceed either 4% nicotine by weight per container or a nicotine concentration of 40 mg/ml.

US - Utah:House Bill 566 has been introduced, which would make it unlawful to give, distribute, sell or offer for sale the following flavoured tobacco products that have a taste or smell other than tobacco, mint, or menthol: an electronic cigarette product, a nicotine product, and tobacco product. If adopted, it would take effect on 1st May 2024.
