The European Tobacco Products Directive (TPD) was transposed into Belgian law by a royal decree on 28th October 2016, coming into effect on 17th January 2017. The decree legalised nicotine-containing e-cigarettes, ending their classification as medical devices.
In January 2023, the Ministry of Health enacted a royal decree amending that of 28th October 2016 on the manufacture and placing on the market of e-cigarettes. The decree entered into force on 11th July 2023, while for retailers it applied as of 11th January 2024. The decree equated nicotine-free vapour products with nicotine-containing ones, especially in terms of product restrictions, notification, and labelling and packaging.
