Market and regulatory data for the vapour sector in Chile

14th January 2025: Chile: The Public Health Institute (ISP) has issued a warning about the harmful effects of e-cigarettes to health. The warning mainly references the declarations made by the World Health Organization (WHO) regarding electronic cigarettes, as well as providing a summary of the new regulations that were adopted in January 2024 but have not yet entered into force.
21st March 2024: Chile: Yesterday, 20th March, the Ministry of Health presented the National Adult Action Plan against Cancer 2022-2027. The plan sets an objective to develop amendments to the tobacco control legislation in line with what is laid out in the World Health Organization Framework Convention on Tobacco Control (WHO FCTC) in relation to tobacco products and e-cigarettes.
11th January 2024: Chile: Member of parliament (MP) Andrés Celis from the opposition coalition has submitted a request to minister of health Ximena Aguilera to urge her to speed up the draft of the developing decree of the recently enacted law 21,642. The law sets up a regulatory framework for e-cigarettes but does not enter into force until the developing decree is issued. The MP asks the minister to provide an estimated date of publication and an idea of the content of the decree.
8th January 2024: Chile: Law 21,642 amending the Tobacco Law to equate all vaping products, regardless of their nicotine content, to tobacco products was published in the Official Gazette on 4th January 2024. The law will enter into force when the Ministry of Health issues the law's developing decree, which is expected by May 2024. The specific provisions to which vaping products will be subjected will be analysed in detail in our country regulatory report, which will be published in the coming days.
12th December 2023: Chile: The National Consumer Service (Sernac) has released a report on the Chilean e-cigarette market, which will be forwarded to the Ministry of Health and the National Institutes of Health (NIH) for their consideration. The report concludes that the lack of regulation in the country poses a threat to consumer safety, but recognises that bills 12626-11 and 12632-11 will improve the situation. Sernac recommends continuing investigation into the health effects of e-cigarettes, since the current scientific evidence is limited.
12th December 2023: Chile: The Constitutional Court declared bills 12626-11 and 12632-11 to be in conformity with the national Constitution last week. The bills, which seek to create a new regulatory regime for all vaping products, regardless of their nicotine content, will now be sent to the president for his signature.
5th October 2023: Chile: The Senate has approved bill 12626-11, which together with bill 12632-11 seeks to equate all vaping products, regardless of their nicotine content, with tobacco products, regulating their sale, advertising and labelling. When the government passes it into law, e-cigarettes will shift from a pharmaceutical regime to a regulated market.
2nd October 2023: Chile: The Senate Health Committee has approved bill 12626-11, which together with bill 12632-11 seeks to equate all vaping products, regardless of their nicotine content, with tobacco products, regulating their sale, advertising and labelling. The Committee will recommend the Senate approves the bill without modifications. If approved by the Senate, the bill will lapse into law.
1st June 2023: Chile: Deputy health secretary Andrea Albagi marked World No Tobacco Day yesterday with a warning against the use of e-cigarettes, saying they are harmful to health and a gateway to smoking, press reports.
9th May 2023: Chile: The Chamber of Deputies yesterday approved Bill 12626-11, which together with Bill 12632-11 seeks to equate all vaping products, regardless of their nicotine content, with tobacco products, regulating their sale, advertising and labelling. The bill was introduced four years ago, and received Senate approval in March 2021. However, it needs to be approved again by the Senate since the Chamber of Deputies proposed several modifications. Should the bill be approved, nicotine-containing vaping products will no longer be subject to the pharmaceutical regime.
25th November 2022: Chile: The Health Committee of the Chamber of Deputies approved Bill 12626-11 on 22nd November. The bill – combined with Bill 12632-11 – seeks to equate all vaping products, regardless of their nicotine content, with tobacco products. The bill, which was approved by the Senate in March 2021, will now need to be approved by the Chamber of Deputies. Currently, nicotine-containing vaping products fall under the pharmaceutical regime.
9th November 2022: Chile: The Chamber of Deputies Health Committee yesterday heard the government’s comments on Bill 12626-11, which, together with Bill 12632-11, seeks to equate all vaping products, regardless of their nicotine content, with tobacco products. The Health Committee agreed in March to drop all provisions relating to vaping products, but they have been reintroduced. The committee has now set a new deadline of 17th November to end the discussion and decide on the bill, which also introduces certain provisions on e-cigarette devices and their components.
