20th January 2025: US - Minnesota: Minnesota attorney general Keith Ellison has taken legal action against Los Angeles-based High Light Vapes, accusing the company of marketing e-cigarettes designed to resemble highlighters. The lawsuit claims the product’s “stealthy” design makes it easy for school-age children to hide and use, raising concerns about targeting under-age users.
2nd September 2024: US - Minnesota: Attorney general Keith Ellison has sent a letter to more than 5,000 tobacco distributors and retailers asking them to confirm they will comply with Minnesota law and stop distributing, marketing and selling unauthorised and illegal flavoured tobacco products in the state. These products include flavoured e-cigarettes and flavoured nicotine pouch products that have not been authorised for sale by the US Food and Drug Administration (FDA). In the letter, Ellison notes that many unauthorised and illegal tobacco products on the market today include e-cigarette and oral nicotine pouch products that feature candy, fruit or dessert flavours that particularly appeal to minors.
29th February 2024: US - Minnesota: A Senate bill has been introduced that would prohibit deceptive vapour products in the state. According to SF 4351, any person or entity must not market, promote, label, advertise or sell a vapour product by imitating a product that is not a vapour product, including school supplies, a food or brand of food commonly marketed to under-21s, or a product based on or depicting a character or personality. It would be also unlawful to distribute and sell products that attempt to conceal the nature of the vapour products from parents and other adults.
18th April 2023: US - General: Juul Labs and its former investor Altria have reached a settlement with the state of Minnesota over Juul’s alleged deceptive marketing. Minnesota attorney general Keith Ellison said: “One of my goals in bringing this case was to send a message: we will not tolerate youth marketing of nicotine products in Minnesota. My office will continue to do its part to protect kids from getting hooked on these harmful products.” Juul has now settled with 48 states and territories, and the company’s priority remains securing authorisation of its premarket tobacco product applications (PMTAs).
28th February 2023: US - Minnesota: A US appeals court has upheld a ban on flavoured tobacco products imposed by the city of Edina. The US Court of Appeals for the Eighth Circuit ruled against the challenge filed by RJ Reynolds to an earlier ruling by a Minnesota district court that the local flavour ban did constitute a product standard but was not preempted due to the “saving clause” of the federal Tobacco Control Act (TCA). The court of appeal ruled that the TCA does not expressly or implicitly preempt a city’s prohibition on selling flavoured tobacco.
