Republic of Ireland regulatory report

E-cigarettes are regulated in Ireland by the European Union (Manufacture, Presentation and Sale of Tobacco and Related Products) Regulations, which were adopted in May 2016, transposing the EU’s Tobacco Products Directive (TPD).

Cross-border distance sales are allowed, as long as retailers are registered.

There is no nationwide ban on vaping in public places.

Advertising restrictions are in line with those prescribed by the TPD.

Interpretation of regulations by the Department of Health has shaped a more restrictive stance than in the UK, for example, requiring health warnings on e-liquid bottles as well as on packaging.

Nicotine-free liquids are unaffected by the May 2016 regulations.

An upcoming public health bill may ban the sale of e-cigarettes to minors under the age of 18.
