Royal decree 579/2017 is the main piece of legislation regulating the manufacture, presentation and sale of nicotine e-cigarettes by transposing the Tobacco Products Directive 2014/40/EU (TPD) into domestic Spanish legislation.
For the last few years the government has been announcing its intention to amend the Tobacco Act. In April 2023, the Ministry of Health held a public consultation on e-cigarette packaging, public place usage, and nicotine-free e-cigarettes.
Following the elections in July 2023, a government led by the former prime minister Pedro Sanchez was formed in November. This means that the plans drawn up during the previous term should be implemented in the next four years.
