13th January 2025: US - New York: Assembly Bill A1636 has been introduced, which would ban the sale of any “quantity of electronic liquid used to refill an electronic cigarette or cartridge”.
8th January 2025: US - New York: Bill A00273 has been introduced. It would prohibit the sale or distribution of e-cigarettes that lack Food and Drug Administration pre-market approval, and impose penalties of at least $10,000 for violations.
8th January 2025: US - New York: Bill A00274 has been introduced. It would increase the tax imposed on the sale of certain tobacco products from 75% to 129%, and increase the tax imposed on the retail sale of vapour products from 20% to 48%.
7th January 2025: US - New York: The following three bills have been introduced: A00100, S00195 and A00671. A00100 would require electronic cigarette packaging to include a warning that the product may pose an explosion hazard. These products would have to be labelled with the following statement: “WARNING: Explosion Hazard: this product may overheat, catch fire or explode.” S00195 would prohibit the sale of vape products that resemble school supplies or toys, or are packaged or advertised in any way to appeal to or target minors or the youth population. A00671 would require a prescription from a licensed physician in order to obtain an electronic cigarette.
11th November 2024: US - New York: New York City mayor Eric Adams announced that the city has filed a lawsuit in federal court against a major e-cigarette distributor company – Price Point Distributors – due to alleged illegal internet sales, which violate federal, New York state and New York City laws. Specifically, the suit states the company is infringing on the Prevent All Cigarette Trafficking (PACT) Act (which prohibits remote sales of e-cigarettes other than to lawfully operating tobacco businesses), the Racketeer Influenced Corrupt Organizations (RICO) Act (which prohibits concealment of information regarding tax collection), NY Public Health Law section 1399-ll (1-a) (which prohibits delivery of e-cigs generally, except to state-licensed vapour businesses) and NYC Admin. Code section 17-715 (which bans the sale of flavoured e-cigarettes).
18th October 2024: US - New York: New York City (NYC) mayor Eric Adams has announced the seizure of over 1,200 lbs of illegal e-cigarette products in NYC for destruction. As a result of the operation by Adams’s administration, the city has seized more than $80m in illegal products. Adams said in a post on social media platform X that “these dangerous, unregulated, and untaxed products are just a small portion of what has been confiscated as part of the ‘Operation Lockdown’ initiative”.
26th September 2024: US - New York: Assembly Bill A10713 has recently been introduced. This bill would prohibit the sale of “entertainment” vapour products, which include any vapour product that has Bluetooth, wireless internet or other internet connectivity, or provides interactive features designed to enhance user experience (such as the ability to play music, display photos/videos, play virtual games or display other animations on the device).
22nd July 2024: US - New York: Democrat councilwoman Kamillah Hanks has introduced a bill in the New York City Council that would prohibit the sale of e-cigarettes that resemble school supplies, including any that could be mistaken for highlighters, staplers, writing pens, or pencils.
3rd July 2024: US - New York: The city of New York has filed a motion of preliminary injunction to immediately block 11 companies from selling their e-cigarettes in the state. The city filed a lawsuit against these companies in April, citing data that kids are becoming addicted to flavoured e-cigarettes at alarming rates. The lawsuit claims that the 11 wholesalers – located in Brooklyn, Queens, Long Island and upstate New York – are accused of selling the vapes in violation of local, state and federal law. “While we have already filed a lawsuit to hold these distributors accountable for their actions, the motion we have filed will help us ensure that they can no longer peddle this poison to our children while this case is being litigated,” mayor Eric Adams said in a statement after the request for an injunction.
21st June 2024: US - New York: State attorney general (AG) Letitia James has announced that funds coming from the settlement with Juul will be allocated to Central New York (more than $4.7m) and the Finger Lakes region (more than $7.4m) to fight what she called the “youth vaping epidemic”. James said: “Juul preyed on young people across our state by putting addictive products into their hands and convincing them that they were harmless. Their actions put a generation of children at risk, fueling physical and mental health problems among young New Yorkers.”
24th May 2024: US - New York: Assembly Bill A10377 has been introduced. The bill would prohibit labelling or marketing vapour products with certain terms, designs or imagery; for example: bubble gum, cake or popsicle. The bill would also prohibit the marketing of materials, images or references to cartoons, cartoon characters, superheroes, television shows, video games or movies used to market to minors. It would further prohibit the marketing of e-cig products with imagery or food brands that have been commonly marketed to minors.
10th April 2024: US - New York: Bill S 9012 has been introduced, which would create a vapour product directory in the state. The attorney general must develop a vapour product directory listing all manufacturers and all vapour products that are sold in the state, and publish and maintain the directory on its website.
