5th July 2024: US - North Carolina: House Bill (HB) 900 has been signed by governor Roy Cooper. HB 900 will create a directory listing vapour products. The directory will include products that have obtained a marketing granted order (MGO) by the US Food and Drug Administration (FDA). It will also include products for which the manufacturer has submitted a timely filed premarket tobacco product application (PMTA) that remains under review or has received a marketing denial order (MDO) that has been stayed by the FDA/court, has been rescinded by the FDA or has been vacated by the court. Retailers selling products not listed in the directory will face inspections, fines and licence suspensions. The legislation is to become effective from 1st December 2024, and from 1st March 2025, every manufacturer will have to submit the required information. Any products not included in the directory by 1st March 2025 cannot be sold in the state.

HB 900 would create a directory that would list vape products eligible to be sold in the state that comply with regulations and guidance from the US Food and Drug Administration (FDA). It would also fine retailers who sell products not included on the directory list.
21st June 2024: US - North Carolina: The North Carolina State Senate Judiciary Committee has approved a proposal added to House Bill (HB) 900 that would create a vapour directory in the state. To become law, the bill would need to pass the Senate and then the House before the end of the session. HB 900 would list vape products eligible to be sold in the state that comply with regulations and guidance from the US Food and Drug Administration (FDA). It would fine retailers who sell products not included on the directory list. If passed, starting 1st May 2025, the secretary of the Department of Revenue would develop and maintain a directory listing all manufacturers of vapour products that have provided certifications.
6th February 2024: US - North Carolina: North Carolina attorney general Josh Stein announced the launch of an online, searchable public depository that will contain nearly four million documents from the state’s lawsuit against e-cigarette manufacturer Juul Labs. The depository was created and is being housed by the University of North Carolina (UNC) at Chapel Hill Libraries and the University of California, San Francisco (UCSF). The first 50,000 documents are now available online in the UCSF Industry Documents Library, and according to Stein, additional documents will be added monthly. “We insisted on a publicly accessible database of Juul’s documents to ensure transparency,” said Stein. “We want people to understand what Juul did so this never happens again.” The documents include information about Juul’s business practices, research, advertisement, marketing, and sales data.
4th April 2023: US - North Carolina: Senate Bill 174 has been enacted and signed by governor Roy Cooper. It amends the definition of vapour products for tax purposes, including all those containing nicotine “however derived”, thereby effectively including synthetic nicotine products under tax regulations.
8th September 2022: US - General: Altria stated that “a jury in the US District Court for the Middle District of North Carolina found that Reynolds Vapor Company’s Vuse Alto e-vapor product infringed three patents owned by Altria Client Services”. The jury has awarded Altria $95,233,292 in past damages, and post-trial proceedings will address ongoing damages. The jury also accepted Altria’s petition to find a royalty rate of 5.25%.
