21st May 2024: Kazakhstan: A new petition has been created against the ban on vaping products in the country, media reports. The petition has reportedly collected 895 signatures and 67 comments. It is unlikely to be successful, as the Law On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Health Issues – which, among other things, seeks to ban the sale, distribution and import of e-cigarettes and e-liquids – has recently been published, and the ban will enter into force on 20th June 2024.
17th May 2024: Brazil: The Senate Committee on Economic Affairs, the Senate Committee on Social Affairs and the Senate Committee on Transparency, Supervision and Control will hold a public hearing on 21st May on the bill that aims to regulate the production, import, export and marketing of electronic cigarettes and heated tobacco. The hearing has been requested by senators from the opposition parties, and anyone can participate via the Senate Ombudsman’s Office.
17th May 2024: Malaysia: The health minister said yesterday (16th May) that the regulations implementing the Control of Smoking Products for Public Health Act 2024 will be issued in June 2024, press reports. These regulations are needed to implement the law, published in February 2024, which created a regulatory framework for e-cigarettes and heated tobacco products.
16th May 2024: Colombia: President Gustavo Petro has signed the Vaping Products Bill, press reports. The bill restricts under-age users’ access to vaping products and limits advertising and promotion of these products. It also imposes labelling and packaging restrictions, such as health warnings. The bill has entered into force today. However, its provisions concerning advertising and labelling and packaging will not be applicable until May 2025.
15th May 2024: Panama: The Supreme Court has declared law 315 – which prohibits the use, importation and sale of e-cigarettes and heated tobacco – unconstitutional. The Association for the Reduction of the Harm of Smoking (the plaintiff) based its case on a formal issue, claiming that the legislative approval process did not comply with constitutional provisions.
15th May 2024: South Korea: The government is planning to amend the tobacco law to regulate synthetic nicotine, press reports. This would end the legal loophole whereby e-liquids containing synthetic nicotine can be freely circulated in the country due to the fact that the definition of electronic cigarettes only encompasses naturally derived nicotine. Closing this loophole has been on the government’s agenda for a few years now.
15th May 2024: Costa Rica: The Ministry of Health has presented the regulations of law 10.066, which establishes a legal framework for the use and sale of vaping and heated tobacco products. Products containing synthetic nicotine and liquids containing cannabinoids will be banned. The authority said it is working on technical regulations that will be subject to national and international public consultation, as well as a bill to correct legal deficiencies in law 10.066.
14th May 2024: Thailand: At a forum on “Protecting Children and Youth from E-Cigarettes” held yesterday (13th May), the National Health Commission Office, government stakeholders and other members of society adopted measures to prevent and control the spread of e-cigarettes, including raising awareness of the dangers and addiction, monitoring and enforcing laws, and confirming policies and measures to prevent and suppress the spread of e-cigarettes.
14th May 2024: Canada: The government published the Excise Duties on Vaping Products Regulations under the Excise Act to formalise and give legal effect to the decision of provinces and territories to join the coordinated vaping product taxation framework. The additional vaping duty would apply to any vaping product stamped on or after 1st July 2024. The regulations provide for a three-month transition period, during which vaping products that are stamped before 1st July 2024 – or that are imported or released under the Customs Act before that day – may be disposed of, sold, offered for sale, purchased and possessed up until 30th September 2024.
14th May 2024: Vietnam: Prime minister Pham Minh Chinh has signed Official Dispatch 47/CD-TTg requesting several ministries to strengthen the control of electronic cigarettes and heated tobacco and take action to prevent their harmful effects. Specifically, the dispatch asks the Ministry of Health to promote solutions to manage these products, the Ministry of Finance to instruct customs to strictly inspect and control transportation of illegal products at borders, and the Ministry of Industry and Trade to strengthen control over organisations that trade and store the products, among other requests.
9th May 2024: Philippines: President Ferdinand R. Marcos Jr. called on the Bureau of Customs (BoC) and Bureau of Internal Revenue (BIR) to expand and strengthen their efforts against smuggling of tobacco and vape products. BIR commissioner Romeo Lumagui Jr. told the president that his agency has intensified its crackdown against smuggled vape products and is going to implement a tax stamp system to determine those that are illicit. As of 1st June 2024, all manufactured or imported vapour products have to carry the internal revenue stamp, according to Revenue Memorandum Circular 105-2023.
