RJ Reynolds Vapor Company plans to challenge the US Food and Drug Administration (FDA)’s rejection of its Vuse menthol vape cartridges, joining a judicial fight that has had mixed results for other companies.
Reynolds will ask an appeals court to stay the FDA’s decision to deny two pre-market tobacco product applications (PMTAs) submitted for the company’s Vuse Vibe Tank Menthol 3% and its Vuse Ciro Cartridge Menthol 1.5%. The promised legal challenge comes amid conflicting opinions about the FDA’s rejection of Reynolds’s PMTAs and a legal landscape that has seen some companies win and others lose.
