8th May 2024: Italy: The Council of State, which is the highest administrative court, has overturned a previous ruling by the Regional Administrative Tribunal (TAR). This ruling had imposed the establishment of an excise tax warehouse for a foreign manufacturer engaged in online B2B sales of vapour products to authorised excise tax warehouses in Italy. The case originated from the Customs and Monopolies Agency (ADM) blocking the website of the foreign manufacturer. The manufacturer appealed to the TAR, which upheld the ADM's decision. However, the Council of State ruled that the TAR had misinterpreted the Tobacco Products Directive (TPD) implementing decree.
15th April 2024: Italy: Following amendments to the Single Text on Excises approved in December 2023 to implement the nicotine-free products excise tax rate on flavoured liquid substances used to prepare e-liquids starting 1st May 2024, the Customs and Monopolies Agency (ADM) amended the Circular 83685/RU. These products will be required to bear tax stamps and be registered with the ADM. Manufacturers or importers will have to establish an excise tax warehouse. Manufacturers, importers and distributors have until 31st July 2024 to sell off remaining stocks, while the deadline for retailers has yet to be determined. It appears that glycol and glycerol will be exempt from taxation, pending clarification of the provision’s scope in a forthcoming circular from the ADM.
13th February 2024: Italy: The Customs and Monopolies Agency (ADM) has updated the lists of notified nicotine-containing and nicotine-free e-cigarette products. The total number of notified vaping products amounts to 25,353.
2nd February 2024: Italy: The Customs and Monopolies Agency (ADM) has updated the excise tax rates for e-cigarettes as of 1st February 2024. The tax rate for nicotine-containing e-cigarettes now amounts to €0.134689 per ml, while the tax rate for those without nicotine now amounts to €0.089793 per ml.
16th January 2024: Italy: The Customs and Monopolies Agency (ADM) has introduced new procedures for obtaining and paying for excise stamps. It has also issued guidelines to ensure compliance with the updated regulations.
11th January 2024: Italy: Parliament has approved the 2024 Budget Law, which maintains the same level of taxation as in 2023. The Customs and Monopolies Agency (ADM) has issued a circular listing the new excise duty rates on e-liquids that apply until the end of the year. As of 1st January, nicotine-containing liquids are subjected to a duty of €0.133431 per ml, while the rate for those without nicotine is €0.088222 per ml.
11th January 2024: Italy: The Customs and Monopolies Agency (ADM) has published the 2022 Blue Book, which shows that the revenue from vapour products (both with and without nicotine) amounted to €39,626,378.89, increasing 123.4% over 2021.

13th December 2023: Italy: The Senate passed the first reading of bill 912, which aims to implement the nicotine-free products excise tax rate on all liquid substances used to prepare e-liquids and would be effective from 1st May 2024. The bill has been sent to the Chamber of Deputies for further discussion and voting.
20th November 2023: Italy: The Customs and Monopolies Agency (ADM) has updated the lists of notified nicotine-containing and nicotine-free e-cigarette products. The total number of notified vaping products amounts to 24,688.
16th November 2023: EU: Ignazio Corrao, Italian member of European Parliament (MEP) from the Group of the Greens/European Free Alliance, has asked the European Commission (EC) a set of questions on the environmental impact of disposable e-cigarettes. Corrao has asked how the EC intends to avoid the infringement of EU legislation on WEEE (governing the treatment of waste electrical and electronic equipment) since these devices “are generally disposed of as unsorted waste”. The MEP also wanted to know if the Commission believes that the principle that e-cigarette manufacturers must take responsibility for end-of-life management of the product either individually or collectively is being complied with. Lastly, he asked what initiatives the EC is considering to encourage the re-use and proper disposal of e-cigarettes.
