Belgium: online sales ban benefits French firms

In our latest report on Belgium, we find that the market is only growing slowly due to online restrictions following the implementation of the TPD. Online sales are banned, meaning sites can only offer in-store collection, and having to print packaging in three languages has proved a barrier to some manufacturers. Meanwhile, French companies – the source of much of the e-liquid – have a strong presence in the south of the country.

Denmark: TPD changes set to boost sales

In 2016 the EU Tobacco Products Directive (TPD) came into force, and the compulsory pharmaceutical licensing of nicotine containing e-cigs and e-liquids ended. This means vape stores and other bricks-and-mortar retailers are now allowed to stock nicotine-containing products, which might increase the proportion of sales coming through this channel. TPD is being transposed as UK plans to leave the EU

In this March 2017 report on the UK market, we find that there is currently no national legal restriction on the public usage of e-cigarettes in the United Kingdom. Variations in interpretation of the TPD include a modification of the six month standstill period for launching new products, while Tank size limits for new products is 2ml and applies to all tanks, regardless of whether they contain nicotine when sold.

Hungary opens for vaping trade, but with stiff restrictions

Hungary has finally opened its market for sale of nicotine e-cigarettes by adopting changes to its national tobacco laws and aligning them with TPD standards. Nevertheless, Hungarian regulation remains among the most severe in Europe. Enforcement of the ban on cross-border and online sales is very efficient, making it almost impossible to buy vaping products online in Hungary. Hungary is also one of the few EU states to have banned flavours.

Portugal halves tax on nicotine e-liquids

Portugal’s 2016 Tobacco Law fully transposed the TPD. A further bill is expected later this year which seeks to ban vaping within five metres of windows or an entrance to health institutions and pharmacies, places primarily intended for people under 18 and educational institutions, irrespective of the students’ age.

Vaping products under new classification in Belgium

A few months after being suspended, a Royal Decree published on 28th October 2016 has finally transposed the European Tobacco Products Directive (TPD) – but with a very important change in the classification of vaping products in Belgium. From 17th January 2017, when the law comes into force, e-cigarettes and e-liquids containing nicotine will be considered consumer products, according to the latest ECigIntelligence regulatory report.
